Burglary charges accuse a defendant of entering or remaining in an unoccupied structure with the intent to commit a crime. This seems simple enough. However, something as straightforward as when the crime allegedly occurred can make a huge difference on your defense. 


As it relates to burglary, for example, the time of day can make a drastic difference. For instance, the distinction between first degree burglary (SDCL 22-32-1(3)) and second-degree burglary (SDCL 22-32-3), is whether the accused conduct occurred in the nighttime.  See State v. Robertson, 2023 S.D. 19, 990 N.W2d. 96.
